Apple’s emergency appeal in Epic Games case rejected by Supreme Court | THE GAVEL

0:00 Just a few hours ago, Apple's emergency docket request earlier today was denied
0:05 at the Supreme Court by Justice Elena Kagan.
0:08 She's the one who got this one by default.
0:09 Didn't even refer it to the full court for a vote.
0:12 And what Apple was asking here for it all had
0:14 to do with contempt because at the trial with Epic Games,
0:18 you know, Epic Games lost most of this case,
0:20 but they did convince a judge to issue
0:22 this order that required Apple for inapp developers,
0:25 they would be allowed to bring their users to external
0:28 softwares to to make inapp purchases outside of Apple's payment system.
0:32 Apple looked at that injunction and said, "Okay, we will comply.
0:35 You know, it says we have to offer those external options.
0:38 We will, but we're still going to charge
0:40 a commission on them." Apple has been trying
0:42 to charge an up to 27% commission even
0:45 on those inapp purchases that are outside of its system.
0:48 So the lower courts here held Apple in contempt.
0:51 They said it violated the spirit of the injunction.
0:54 They're continuing to fight this contempt,
0:55 but their concern was that what's actually going
0:57 to happen now is a judge is about to hold
0:59 some proceedings to decide what legal percentage can
1:02 Apple charge for its inapp purchases under this injunction.
1:06 And Apple had been very concerned that if it has to go
1:08 through those proceedings under the label that it is in contempt of court,
1:13 uh that it wouldn't look kindly on the company.
1:15 So, it actually wanted the Supreme Court to put those proceedings
1:17 on hold at least until it could finish its contempt fight.
1:20 But, as I said, Justice Elena Kagan very quickly turned this away.
