0:34 on the car because he refuses to return her big screen TV.

0:52 Well, starting about 2001, 2002, we met online through a mutual friend who gave

0:58 her my email address and we started corresponding back and forth.

1:02 Started hanging out after that.

1:04 And about 3 months later she kind of moved in.

1:08 I don't even recall if I let her move in.

1:10 She just kind of was there one day.

1:12 All of her stuff was there.

1:14 You didn't ask her about it?

1:16 Well, you know, at the time she didn't really have a place to stay

1:19 and she it was kind of convenience probably for her and I didn't object.

1:24 You know, we got along well.

1:25 That's not true.

1:26 Um when she first moved in, you know, she was working.

1:28 She was employed.

1:30 Of course, you know, that didn't last.

1:32 A week later after she had moved in and

1:35 paying all your bills before she came, right?

3:27 I think uh I think this is it, you know." Gave her a hefty bag and I said,

3:30 "Here, why don't you go ahead and put your That's not true.

3:36 First of all, your honor, Jasper and I dated um a couple years ago.

3:42 Um he had serious anger issues.

3:45 Um he was he had guns, which was kind of scary.

4:13 One time we were getting into our vehicle and we had just

4:17 gotten a puppy and a car drove by and he grabbed the puppy,

4:21 threw it out of the car and jumped in the car and locked the door

4:23 and me and the puppy are just standing there like what do we do now, you know?

4:27 Did you ever ask him about it?

4:29 Um I did.

4:30 I think we got in a really big argument and that's

4:33 part of the the reason that I broke up with him.

4:36 Sir, let's talk about the car you're suing for.

4:38 The balance due on a car.

4:40 Well, uh basically we had after we broke up,

4:44 we hadn't really talked for about 3 years or so

4:46 and she shot me an email and we started talking again,

4:50 you know, she came over and we started hanging out a little bit.

4:53 Nothing at all going towards that direction of what happened before.

4:57 Just as friends.

4:59 So, and at the time and she had a kid.

5:02 She had a uh truck that was her baby's father's truck and they

5:06 were going through problems so he was going to take back the truck.

5:09 So, and I had a car that I was trying to sell.

5:11 So, she showed her interest in the vehicle and you know,

5:14 I again felt sorry for her so I said,

5:18 "All right, well, I'll sell it to you." But she said,

5:20 you know, "I don't have the cash right now." She said, "Well,

5:23 how about this?" She basically gave me a big screen TV and she said,

5:26 "I'll give you a TV.

5:27 Just you can have the TV.

5:29 I got nowhere to put it anyway."

5:30 Got you.

5:31 And she gave me 250 bucks to start out with.

5:33 So, the balance she was to pay?

5:35 What was The balance?

5:37 TV and 250, what was she to pay?

5:39 Well, the TV had nothing to do with the balance.

5:41 What did you all agree on?

5:43 $3,000.

5:44 to the car.

5:45 Obviously, the TV had nothing to do with it, you say.

5:47 Well, I just wanted to explain the reason why the TV came

5:50 into the picture was because I didn't want to sell it to her.

5:53 She wanted to make payments.

5:56 She wanted to make payments, monthly payments.

6:00 The it comes into play because I wanted to sell the car outright and she said,

6:04 "Well, I'll give you the TV if you let take the TV, right?

6:17 No, I I took it as a I took it so that I would let her make payments, basically.

6:21 What was the balance after the TV and the 250?

6:25 And the 250 was Well, it was 3,000 so after the 3,000 Now,

6:53 So, I told him I said, "I have this big screen TV that I'll give you, you know,

6:57 That's what he said.

6:58 And 250 you also gave him?

7:00 Um and $250.

7:01 What was the remaining balance you were to pay?

7:04 Um well, it was three $3,000 minus that 250.

7:08 I would assume that after receiving a certain amount,

7:13 after giving a certain amount, you would know what's owed to you and you

7:20 would know how much you owe before coming in here

7:24 today and telling me to do the math on what you are owed and on what you owe.

7:30 Well, it was 250.

7:30 So, if nobody knows, we have no agreement and we can all go home.

7:35 No, sir, I know.

7:39 And obviously, she's paid a significant amount

7:41 because you're only suing for $1,535, correct?

7:46 That's correct.

7:47 She made two more payments.

7:48 What's the total amount of payments she's made?

7:52 So, she should owe only 2,000.

7:54 Yeah.

7:55 I I sold the wrecked vehicle.

7:57 Basically, she had the vehicle.

7:59 She hadn't finished paying for it.

8:01 She crashed it in a DUI crash.

8:03 Well, we went down to the tow yard.

8:04 I had to pay $195 out of my own pocket to get the vehicle out of the tow yard.

8:09 And That's why you want that.

8:10 Is this true?

8:11 That's true, but he didn't give me a chance to get the car out myself.

8:15 I was he had plans when he picked me up.

8:18 He said, "This is what I'm going to do." Because the car was still in his name.

8:21 I kind of had no say over what I could do with the car.

8:24 He said, "I'm going to get the car out and I'm going to sell it for, you know,

8:28 whatever amount I can get for it." because if he hadn't gotten the car out,

8:33 they would have continued to charge a daily amount and the amount you owe now,

8:40 195, would have been significantly more.

8:43 And the reason I say the amount you

8:45 owe is because it was your responsibility to pay

8:49 because you were negligent in the operation

8:52 of his of the vehicle that you had not paid for.

8:56 Therefore, I'm going to grant this entire judgment, $1,535.
